Personal Injury
When individuals sustain a personal injury in an accident due to the carelessness or negligence of others, they are entitled to certain rights and benefits, often in the form of cash awards, injured individuals may initiate legal action to recover for: among others, lost earnings, disabilities, medical expenses and loss of enjoyment of life. Since there is a time limitation with each personal injury claim, it is very important to obtain legal advice as soon as possible.
Slip/Trip and Fall
Individuals are entitled to initiate a lawsuit if they have been injured by tripping or slipping on a sidewalk, staircase or other surface, provided a defective condition was the cause, and that the party responsible for the maintenance of the area had prior notice of the condition. Property owners, tenants, managing companies and maintenance companies are responsible for keeping their property in a reasonably safe condition. Failure to do so may give rise to a negligence action.
Construction Accidents
Unlike most personal injury cases, workers injured at a construction site often don’t have to prove fault or negligence. A New York law imposes, in certain situations, absolute liability against contractors and the owners of certain premises. In such cases, only proof of a defective condition is required.
Motor Vehicle Accidents
As a victim of a motor vehicle accident, an individual has to basic rights:
- NO fault benefits: Injured individuals are entitled to certain benefits regardless of who is at fault. Whether a pedestrian, passenger or driver of a motor vehicle, his or her medical bills, and a certain portion of lost wages will be paid by the vehicle’s insurance company.
- Litigation: If an individual sustains a serious injury and another party is responsible and at fault due to negligence or carelessness that person is entitled to pursue a personal injury lawsuit. In this lawsuit, individuals may recover cash awards or a settlement.
Defective Products
Manufacturer’s designers and distributors are responsible for providing a product which is reasonably safe. If a person uses a particular product as it was intended and sustains an injury, that individual has the right to bring a product liability case.
